Order fulfillment regulations

1. GENERAL PROVISIONS

1.1. The website available at http://www.apricots.pl/ is operated by YELLOW APRICOTS Sp. z o. o., with its registered office in Warsaw, at ul. Stefana Okrzei 6, apt. 30, 03-720. The company is registered in the Register of Entrepreneurs under the KRS number 0001120342, maintained by the District Court in Warsaw, 13th Commercial Division of the National Court Register, Tax Identification Number (NIP): 1133142188.

1.2. The YELLOW APRICOTS website, located at http://www.apricots.pl/ , provides information about original YELLOW APRICOTS brand products.

1.3. The terms and conditions of sale and the products offered on the YELLOW APRICOTS website apply only to transactions carried out in Poland.

1.4. The sales contract is concluded between the buyer and YELLOW APRICOTS Sp. z o. o.

1.5. The key provisions of the contract are recorded, secured and made available by printing and attaching a VAT invoice to the shipment delivered to the customer.

2. PLACING ORDERS

2.1. The presentation of products on the YELLOW APRICOTS website does not constitute a commercial offer or a listing of items for sale within the meaning of Article 543 of the Civil Code. A sales contract between the buyer and YELLOW APRICOTS Sp. z o.o. is concluded by accepting the order placed by the buyer, in accordance with the provisions of these regulations. This order constitutes an offer to purchase the goods indicated by the buyer.

2.2 Orders are processed only within Poland. When placing an order, please use Polish.

2.3. An order will be accepted if the goods are in stock. If some of the products included in the order are unavailable, the customer will be informed of the order status and will decide how to proceed (partial fulfillment, extended waiting time, or cancellation of the entire order).

2.4. Sales are made in accordance with the prices contained in the price list or individual offer of YELLOW APRICOTS Sp. z o. o., which are provided to the customer upon request, applicable on the date of sale and increased by applicable VAT. The prices stated in the price list or offer of YELLOW APRICOTS Sp. z o. o. do not include VAT.

3. PRICES AND PAYMENT TERMS

3.1. Sales are made in accordance with the prices listed in the price list available on the YELLOW APRICOTS Sp. z o.o. website, applicable on the date of the transaction, or based on an individual offer, if one is presented to the buyer. These prices are increased by applicable VAT. Prices in the YELLOW APRICOTS Sp. z o.o. price list do not include VAT.

3.2. YELLOW APRICOTS Sp. z o. o. reserves the right to change the prices of products offered on the website, add new products to the offer, organize and cancel promotions, and make changes to the website.

3.3. You can pay for goods ordered from YELLOW APRICOTS Sp. z o.o. by bank transfer or by VISA or MasterCard credit card.

3.4. A VAT invoice is issued for each order. The payment deadline is indicated on the VAT invoice.

3.5. Generally, delivery of ordered goods takes place within the time specified in YELLOW APRICOTS Sp. z o.o.'s offer after order confirmation. Detailed delivery terms and delivery price list can be found in the General Terms and Conditions of Delivery, Payment, and Service Provision, which are available in their current version on the YELLOW APRICOTS Sp. z o.o. website. YELLOW APRICOTS's liability for delays in delivery is limited to twice the freight charge due to the carrier or forwarder. The company reserves the right to make partial deliveries.

4. FINAL PROVISIONS

4.1. YELLOW APRICOTS Sp. z o. o. reserves the right to make changes and adjustments to the provisions of these Order Fulfillment Regulations. Updated provisions are effective if they were made available to the Customer at the time of placing the order.

4.2. In matters not regulated in these Order Fulfillment Regulations, the "General Terms and Conditions of Delivery and Payment by YELLOW APRICOTS Sp. z o. o." shall apply.

4.3. The court with jurisdiction to resolve any disputes arising from the sales agreement is the court with jurisdiction over YELLOW APRICOTS Sp. z o. o.

4.4 The Regulations are effective from November 1, 2024.
